 The Rajasthan High Court quashed the state government decision of providing 20 per cent reservation to youths in Civic Bodies Elections.
The division bench comprising Chief Justice Jagdish Bhalla and Justice M N Bhandhari while issuing order in the petition by one Mohammad Kaleem of Sikar, declared ultra vires the provision added in the Rajasthan Municipalities Act (Amendment) 2009 which provides 20 per cent reservation to youth aging between 21 and 35 years. The petitioner challenged the move pleading that the age and gender based reservation was in violation of Article 14 of the Constitution.
The ruling Congress had promised reservation to Youth in its manifesto for Lok Sabha polls-2009. Accordingly, the Congress-led state government had last year amended the act to incorporate the provision with the motive to extend the benefit to them in the civic polls of October-November 2009. However, the High court in its earlier interim order had stayed the provision.
